New regulations make it possible, in theory, for municipal governments with good financial standing to purchase electrcity directly from Independent Power Producers (IPPs). Previously, only Eskom could structure power purchase agreements (PPAs) with IPPs. National Treasury is still working out the regulatory framework to enable this decision, allowing it to be implemented within all relevant legal requirements, including the Municipal Finance Management Act (MFMA) 56 of 2003.
