The City of Cape Town made brought a High Court Challenge against the Minister of Energy and the National Energy Regulator of South Africa (NERSA), challenging the single-buyer arrangement in which only Eskom may enter into power purchase agreements with independent power producers (IPPs). The City argued for the legal right of municipal governments to procure power from IPPs, in the same way that Eskom transacts with these entities.
